This game is organized by Incredible Games Private Limited (“Company”).
The game shall be made available on a daily and/or weekly basis and/or as deemed fit by the Company.
The Participant agrees and confirms that they have read and understood the terms and conditions stated herein, the Terms of Service and the Privacy Policy contained on the App and by participating in the game they accept all of these.
Company reserves the right to change the terms and conditions of the game, the Terms of Service and the Privacy Policy, including extending, withdrawing or canceling the game at any time without prior notice.
This game is open to all participants above 18 years of age. On winning, the Company is entitled to call for a supporting valid document in relation to the age and territory of the participant such as Aadhar card, Passport or driving license. In case a valid document is not provided or is not legible, the Company can withdraw, suspend the winning and also restrict the participant from participating in the game and using the App.
To participate in this game, the participant needs to be residing in India.
Participants residing in the state of Assam, Odisha, Nagaland, Sikkim, Tamil Nadu, Andhra Pradesh and Telangana are prohibited from participating in the game on the App.
The participant needs to Spin the Wheel to land on a prize. On landing on a particular prize, the participant would have to answer questions posed for winning the prize and enter the lucky draw. Every correct answer given by the Participant shall entitle the participant to win a ticket i.e. one ticket per correct answer. The participant can answer up to 5 questions correctly and then, can either watch an advertisement to continue playing further to earn more tickets or can enter the lucky draw for winning the prize with the earned tickets.
Every ticket won qualifies for the lucky draw for winning the prize. The more tickets one wins by answering more questions correctly, the more it increases the possibility of the participant to win the prize by participating in the lucky draw.
If the participant chooses to enter the lucky draw, the participant is once again given the option to play further by watching an advertisement and win more tickets or to enter the draw with the tickets won.
Once the participant chooses not to play further and enter the lucky draw, the participant would be able to view the time, when the draw would happen.
The participant can play multiple times by answering questions correctly for different prizes on the wheel including the same prize arrived at or won previously, as per the prize that may be arrived at on spinning the wheel.
The winner shall be selected by a computerized lucky draw from pool of tickets submitted by all the participants (“Winner”).
The selection of the winner shall be at the sole discretion of the Company.
There shall be one winner selected by the Company for every prize.
There is no cash alternative to the Prize. The Prize is non-transferable.
The winners shall be declared on a daily and/or weekly basis and/or as deemed fit by the Company.
The prize may be a product or Paytm cashback (“Prize”). The product would be as available and as desired by the Company at its sole discretion. Paytm cashback would be directly deposited in the Paytm wallet by the Company, while the product won shall be delivered via any e-commerce delivery companies such as Amazon, Flipkart, etc. Please take note that the Company is not affiliated to such delivery partner/s and the delivery shall be done as per such delivery partner’s norms, terms and conditions applicable.
The prize in the form of the product shall be on “As-Is and As Available” basis and makes no written or oral or express or implied warranty whatsoever as regards its type, brand, merchantability, fitness, usefulness, likeness, etc. and shall not be responsible in any manner whatsoever. The winner may approach the manufacturer/distributor of the product in relation to its available warranty, if any, as may be available and provided along with the product.
The participant would need to log back into the game and check the status of the winners within 90 days of participation. In the event the participant has won, he would receive a notification/pop-up/communication to submit his/her email ID in case of a product or his Paytm number in case of a Paytm cashback. Thereafter, the winner will receive an email from the Company asking for his/her postal address, contact information and documents. If he/she fails to provide the same within the stipulated timeline, the prize will be lost/nullified.
The winner shall be responsible to provide accurate and correct details such as email ID, postal address, contact details, ID proof, etc. for the delivery of the Prize and the Company shall not be responsible and/or liable if the prize is not delivered to the winner due to his/her providing incorrect or inaccurate details and information and further, the Company shall not be liable to compensate the winner for the same.
On receipt of proper information as required and in the required format, from the winner, the Company shall have the prize dispatched/transferred within 7 business/working days.
The Company shall provide the winner with proof of purchase and dispatch in the form of screenshots of the order ID from the delivery company.
In case where the winner’s address is non-deliverable or non-serviceable by the delivery companies, the winner shall be informed of the same by email. On receipt of email, the winner shall require to reply back within 15 days suggesting whether the winner desires the prize to be delivered at an alternate address, in which case the winner would be required to provide the same or desires to pick the prize from the nearest available delivery company pick-up point or desires to visit the office of the Company, with identity proof, and claim the prize. On receipt of such information from the winner, the Company shall make the required arrangement and inform the winner. In the event of pick up opted by the winner, the same shall be required to be done within the time prescribed by the Company and at the winner’s own cost and expenses. In any event the Company shall not be liable in any manner whatsoever, including but not limited to compensating the winner for any reason whatsoever, for such un-serviceable locations or pick up not being made within the required time-frame.
The winner acknowledges that the Company has no control on the delivery timelines and state of the parcel through the delivery company.
In case of any force majeure situation that is beyond the control of the Company such as strike, lock-down, epidemic, pandemic, war, civil commotion, government or judicial or quasi-judicial order or rules or regulations or restrictions, etc., the Company shall not be held liable for any delay in the delivery of the prize and the same shall be delivered only once the force majeure condition ceases.
In case the prize is defective/damaged, the winner needs to provide an unboxing video/proof of his/ her claim of damaged/defective product within 24 hours of receiving the prize. The Company would review and decide on such claim at its sole discretion and would be bound by the delivery company’s return/replacement policy. The winner shall accept and abide with the decision of the Company and the Company’s decision in all such claims shall be final and binding on the winner.
The winner shall be responsible to attend any calls/communication from the delivery company and from the company representative with regard to the delivery of the prize and assist the delivery person to perform a successful delivery
The Company will assume the delivery status of the order on the delivery company’s website/App as a valid proof/document of delivery.
The Company shall not be liable in any manner whatsoever for any claims, losses, damage, costs or expenses in connection with or arising from the game, the participation of the participant in the game, the redemption, acceptance or use of the prize/s or inability of the winner to utilize the prize.
All the third-party trademarks (including logos and icons) referenced by the Company in the App remain the property of their respective owners. Unless specifically identified as such, the Company’s use of third-party trademarks does not indicate any relationship, sponsorship, or endorsement between the Company and the owners of these trademarks. Any references by the Company to third party trademarks is to identify the corresponding third-party goods and/or services and shall be considered nominative fair use under the trademark law.
The Company reserves the right but shall have no obligation to use the winner’s image, photograph, name and likeness in post-promotion publicity material and in advertising, marketing or promotional material in any media by any means throughout the world for any purpose connected with the game and the participant grants the Company the right to the same without any objection.
The winner(s) might be required to share an image and/or recorded video along with the prize and the winner(s) hereby give their express permission to the Company to freely distribute its image and/or video in any publication and media whether online, offline, on television or on the Internet or any media whatsoever without any compensation whatsoever.
The participant undertakes to indemnify and keep the Company harmless and indemnified against any loss, damage, claims, costs and expenses which may be incurred or suffered by the Company due to breach of any of the terms and conditions herein contained.
This game shall be governed by the laws of India.
Any disputes, differences and/or any other matters in relation to and arising out of this game or pertaining to these terms and conditions or the prize shall be subject to exclusive jurisdiction of the courts at Mumbai alone.
